Welcome to the Myyaffiliate Privacy Notice (“Privacy Notice”). Digital Trading Science & Technology (Beijing) Co. Ltd. (“Myyaffiliate” “we,” “us,” or “our”) is an affiliate marketing company. We’ve created this resource to provide you as a client with valuable transparency and choice on how we might collect, use, and share your personal information.

1.What information do we collect?

Information that you provide voluntarily

Certain parts of our Websites may ask you to provide personal information voluntarily. For example, when Clients are registering for a Myyaffiliate account, expressing an interest in obtaining additional information about Myyaffiliate or our products and services, subscribing to marketing or otherwise contacting us, Myyaffiliate collects required personal information from you. The personal information that you are asked to provide (and the reasons why you are asked to provide it) will be made clear to you at the point we ask you to provide your personal information. We will also let you know prior to collection whether the provision of personal information we are collecting is compulsory or may be provided on a voluntary basis, and the consequences (if any) of not providing the information. We also collect personal information you otherwise submit to us, such as when you send Myyaffiliate an email.

The personal information we collect may include contact information (such as your name, address, telephone number or email address), your request (record of sample request), promotion record, payment channel information (your bank account information/Paypal account information), and fund withdrawal record.

Information we collect automatically 

When using our Websites, we may automatically collect certain information from your device or computer. In some countries, including countries in the EU, this information may be considered personal information under data protection laws. Specifically, the information we collect automatically may include your device information, network information, web browsing record, and how you interact with our Websites and other websites. We may collect this information as a part of log files as well as through the use of cookies or other tracking technologies, as explained further under the heading “Cookies and similar tracking technology.”

Information we collect from third party sources:

We may obtain information about you from other sources, such as public databases, joint marketing partners, data providers, and social media platforms. Examples of the information we could receive from other sources include account information, page-views, and browsing information.

2.How do we use your information?

We use the information we collect or receive to:

Send administrative information to you. For example, to send you product, service, and new feature information and/or information about changes to our terms, conditions, and policies.

Engage in and process transactions. For example, we may use your personal information along with financial, credit card, and/or payment information that you provide to us to process your transactions and for billing purposes. Note that Myyaffiliate uses third-party vendors to collect and/or process any financial or payment information, and does not itself collect, receive, or process financial or payment information on its own.

Respond to your requests. For example, we may use your personal information to fulfill your request for a quote or customer support, or to provide you with information you have requested about the Websites or Myyaffiliate Ad Services.

Post testimonials. We post testimonials on the Websites that may contain personal information. Prior to posting a testimonial, we will obtain our consent to use your name and testimonial. If you wish to update, or delete your testimonial, please contact us at [affiliate@myyaffiliate.com] and be sure to include your name, testimonial location, and contact information.

Manage your account and provide support or other services. For example, for the creation or administration of your Myyaffiliate account, to communicate with you, and to provide you with customer support or other services you have ordered, such as product updates, product patches and fixes and other similar operational communications.

Select content and improve quality. We may use your information to help improve the Website, Myyaffiliate Ad Services, and to ensure that content on the Websites is presented in the most effective manner for your device (for example, by presenting products and offers tailored to you).

Protect the Myyaffiliate Websites. We may use your information as part of our efforts to keep the Websites safe and secure (for example, for fraud monitoring and prevention).

For our business purposes. We may use your information for our business purposes, such as data analysis, audits, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our products, services, marketing, and client relationships.

3.Cookies and Similar Technologies.

We may use cookies and similar technology (collectively “cookies”) on our Websites to collect and process personal information about you. At any time, you may use your browser settings to change your cookie preferences or control use of cookies.  By continuing to browse, you agree to our use of cookies. 

4.How do we share your information?

We may disclose your personal information to the following categories of recipients:

Vendors, consultants and other service providers. We may share your information with third party vendors, service providers, contractors or agents who perform functions required for the operation of our business. Examples include to provide data storage and processing services, fraud prevention, technical support for our Platform, analyzing data and performing analysis related to the Website, Platform and related services, and delivering content.

Compliance with laws. We may disclose information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

Disclosures for national security or law enforcement. Under certain circumstances, we may be required to disclose your personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Vital interests and legal rights. We may disclose information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Notice, or as evidence in litigation in which Myyaffiliate may be involved.

Myyaffiliate affiliates.  We may share information with our parent companies, subsidiaries and/or affiliates for use and processing purposes described in this Notice.

Business transfers. We may share or transfer information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company, provided that we inform the buyer it must use your personal information only for the purposes disclosed in this Notice.

Consent. We may share your information with any other person with your consent to the disclosure.

5.Your data protection rights.

 

You have certain rights in relation to your personal information. These include the right to object to the processing of your information for certain purposes, the right to access your personal information, the right to correct your personal information, the right to delete your personal information, the right to file a complaint, the right to withdraw your consent, right related to automated decision making and the ability to erase, restrict or receive a machine-readable copy of your personal information, and other rights granted under applicable data protection laws.

Other Rights (applicable to California and EEA residents only): If you are a resident of California or the European Economic Area (“EEA”), legislation in your jurisdiction – such as the California Consumer Protection Act (“CCPA”) and the General Data Protection Regulation (“GDPR”), respectively – affords you certain specific data protection rights, as noted below. If you make a request, to protect your privacy and security, we will take steps to verify your identity and requests before granting the rights set forth in this Notice.

CCPA rights (California residents)

Please note that, under certain circumstances, we have the right to impose a small fee for access and disclosure of your personal information where permitted under applicable law, which will be communicated to you. Nevertheless, Myyaffiliate will honor any “opt-out of sale” requests we may receive from our Clients, and accordingly take reasonable measures to prevent any further downstream sales. Myyaffiliate does share personal information as described in this Notice.

6.Additional information for California Residents.

California law requires us to provide California residents with some additional information regarding how we collect, use, and share your “personal information” (as defined in the CCPA). Throughout this Notice, we discuss in detail the specific pieces of information we collect from you or your device and discuss how we use and share such information.

As described in detail in Section 1 above, we may collect the following categories of information about you through your use of the Websites: identifiers (such as name and contact information); commercial information (such as transaction data); financial data (such as credit card information through our payment processors); device identifiers (such as IP address); internet or other network or device activity (such as browsing history or app usage); geolocation information; and other information that identifies or can be reasonably associated with you.

We disclose the following categories of personal information for business purposes: identifiers; commercial information; financial data (via our payment processors); device identifiers; internet or other network or device activity; geolocation information; and other information that identifies or can be reasonably associated with you.

As described in detail in Section 2 and above, we use and disclose the information we collect for the business purposes described in this Notice, including: to provide and improve the Myyaffiliate Ad Services and the Websites, for our operational purposes, for the operational purposes of our service providers, for audit purposes, to detect security incidents and prevent fraud, for debugging and repairing errors, to communicate with you, to provide customer service, to market Myyaffiliate services, and for other uses that we notify you about.

We may disclose your personal information to the categories of recipients described in detail in Section 4, above.

7.Legal basis for processing personal information (EEA residents only).

If you are an individual from the EEA, our legal basis for collecting and using personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, we normally rely on our legitimate interest to collect personal information from you, except where such interests are overridden by your data protection interests or fundamental rights and freedoms. Where we rely on our legitimate interests to process your personal information, they include the interests described in the sections headed “How do we use your information?”

In some cases, we may rely on our consent or have a legal obligation to collect personal information from you, or may otherwise need the personal information to protect your vital interests or those of another person. If we rely on consent to collect and/or process your personal information, we will obtain such consent in compliance with applicable laws.

8.How do we keep your personal information secure?

We use appropriate administrative, organizational, technical, and physical safeguards to protect the personal information we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information and to help ensure that your data is safe, secure, and only available to you and to those you provided authorized access. Specific measures we will use include hashing and pseudonymization of data prior to storage. However, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so you should take care in deciding what information you send us in this way.

9.Data Retention.

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to comply with applicable legal, tax or accounting requirements, to enforce our agreements or comply with our legal obligations). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such data or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

10.International Data Transfers.

The Myyaffiliate Ad Services and Myyaffiliate Websites are provided, supported, and hosted in the Hong Kong Special Administrative Region of China. If you are using the Myyaffiliate Ad Services and Myyaffiliate Websites from outside Hong Kong, be aware that your information may be transferred to, stored, and processed by Myyaffiliate in our facilities. We will sign standard contractual terms with data exporters approved by the European Commission or take other similar measures to protect your personal information from infringement. We may share your personal information with third parties located in countries that may have data protection laws that are different to the laws of your country.

However, we have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Notice. These include implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect personal information they process from the EEA in accordance with European Union data protection law. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third party service providers and partners and further details can be provided upon request.

11.Changes to this Privacy Notice.

Myyaffiliate will review and update this Privacy Notice periodically and will note the date of its most recent revision above. If we make material changes to this Privacy Notice, we will notify you either by prominently posting a notice of such changes prior to implementing the changes or by directly sending you a notification. We encourage you to review this Privacy Notice frequently to be informed of how Myyaffiliate is protecting your information.

Scope of this Privacy Notice

To make some of our services possible to our Clients and to make smarter decisions, we need to process consumer personal information. This Privacy Notice is intended to describe how your personal information as a consumer is collected and used by Myyaffiliate on behalf of our Clients as entrusted party (a.k.a. data processor under the GDPR) while providing our affiliate marketing services to our Clients. We believe that your privacy and data protection is essential to the growth and prosperity of the internet, and that a great online experience can provide significant benefits to consumers when done properly. In accordance with these beliefs, Myyaffiliate strives to create results for publishers, advertisers and consumers in revolutionary ways without compromising privacy.

This Privacy Notice is created and maintained as part of our commitment to provide you with transparency and choice on how we process their personal information. We have taken steps to describe our personal information processing activities as clearly and easy-to-read as possible and encourage you to read the entire Privacy Notice. I. Overview of Myyaffiliate and Affiliate Marketing

When you visit websites and mobile applications, there are almost always third parties working behind the scenes to help provide a great digital experience. Myyaffiliate is one of these companies and we offer affiliate marketing technology and services that keeps your favorite blogs free, your favorite stores in business, and your experience with brands more relevant.

1. What do we do?

Affiliate marketing is the process of a brand (for example, a retailer) paying a commission to a publisher (for example a blog or a news site) for the transactions the publisher helps to drive by promoting the brand’s products or services. Publishers will promote products or services from advertisers to visitors of their properties (examples include websites or mobile applications) and earn a piece of the profit for each transaction generated. Myyaffiliate operates an affiliate network, which helps publishers and advertisers partner with each other. An affiliate network is the platform used by publishers and advertisers to discover and form new partnerships, define criteria for qualified marketing efforts and is used to ensure that appropriate parties are rewarded for qualified activities.

2. Privacy by Design

We have a deep-rooted foundation and culture of privacy and data protection at Myyaffiliate. We integrate privacy in all aspects of our business, including strategy, product development, delivery, and more. We set a ‘privacy-first’ tone early and often, proactively working to limit our data collection to what is necessary to provide our services.

In that spirit, Myyaffiliate does not collect, store, process, or allow in our systems any of your personal information that is linked, or is intended to be linked, to an identified individual, such as names, addresses, phone numbers, email addresses, driver’s license numbers, or financial account numbers, which we define as directly identifiable information (“DII”). We have built, and continue to build, all our products and services without the use of any DII.

As part of our Privacy by Design philosophy, we consider and prioritize data protection and privacy throughout the entire lifecycle of the data from before it is collected to when it is ultimately destroyed. We constantly strive to maintain unparalleled visibility with consumers. We provide transparency and choice through our website and encourage the same practice throughout the internet.

II. Information Collection & Use

Unless voluntarily provided by you, Myyaffiliate does not collect or use any DII. Instead, Myyaffiliate only processes pseudonymous personal information. Pseudonymous or pseudonymized personal information is information that does not directly identify a specific consumer without the use of additional information. Myyaffiliate only collects and processes personal information in a pseudonymous format and has both technical and organizational measures in place to make sure that additional information is not used to identify or link that pseudonymous information to an identified consumer. Some examples of pseudonymous information that we process include UID, order IDs, Order value ,click ID and browsing activity. We do not link or attribute pseudonymous information to DII, such as a your name, email address, or phone number.

Using pseudonymous information allows us to see and understand your journey between publishers and advertisers without revealing to us your identity. In other words, we do not directly identify you using the pseudonymous information that we process. In fact, we have no interest in knowing your DII details, and we work to proactively keep such information out of our systems. We will only ever collect DII if it is expressly provided to us, such as when you contacts us on your own initiative via our contact form or otherwise. Even in these instances, we will not tie this DII to pseudonymous information about you that we may have, such as your site browsing or transaction data.   

1. Pseudonymous Information Collected by Myyaffiliate

The majority of the data that Myyaffiliate processes is machine generated and is collected when a consumer visits and interacts with one of our advertisers or publishers, such as a website or mobile application that leverages our services. Such information includes the following:

· Commercial or transactions information: E.g., information relating to online purchases and actions made by you, order IDs, order timestamps, and other purchasing information of products and services.

· Identifiers and Device Information: E.g., hashed emails, mobile identifiers (such as IDFA or AAID), Cookie IDs, user agent strings which provides browser type and version, and IP address.

· Online browsing activity information: E.g., browsing activity and information on your interaction with a website, application, or advertisement where our technology is deployed, such as clicks, ad impressions, time stamps, referring site URLs, and current site URLs.

· Location data: E.g., location information based on IP addresses.  

2. How Myyaffiliate Collects Pseudonymous Information

Information Collected Online:

We collect the types of pseudonymous information identified above in a variety of ways. However, we principally use Reporting Technologies, such as cookies,  pixels, tags, or other similar technologies to collect the pseudonymous information we need to provide our services. We leverage these technologies to collect the necessary pseudonymous information from you directly as you navigate or interact with our advertisers and publishers.

Information Received from Clients:

Our Clients may also provide us with information relating to their customers, prospective customers, or other individuals, which we handle on the behalf of our Clients as a service provider. Our Clients are independently responsible to determine how they engage with their customers and determine the handling of their customer data. Under these circumstances, the use of such personal information is subject to the privacy policies of the client’s privacy policies. We are not responsible for other privacy practices of our Clients, and accordingly, this Privacy Notice and the rights acknowledged herein do not apply to those data processing activities.

3. Myyaffiliate’s Purposes for Collecting Pseudonymous Information

Myyaffiliate collects pseudonymized personal information for a variety of purposes, as detailed below.

Attribution: Myyaffiliate primarily uses pseudonymous information to attribute a referral or marketing effort by a publisher to an event or transaction with an advertiser. When a consumer responds to or views an affiliate advertisement served by one of our publishers, we may assign a unique identifier that is tied to that consumer’s internet browser or device, often via a cookie or similar technology. One function of these technologies is to provide Myyaffiliate with the information needed to facilitate the verification and payment of affiliate commissions to a publisher when a consumer clicks on a link, creates a lead, or makes a purchase directly on an advertiser’s website. Even if the consumer re-visits the advertiser's site directly, Myyaffiliate is able to recognize the unique identifier assigned earlier, and is able to continue to attribute the consumer’s activities on the advertiser's site and credit the publisher that referred the consumer where appropriate. In other words, if a consumer reads a blog about a pair of shoes and decides to visit that advertiser’s website and purchase that pair of shoes, we would ensure that the blog gets compensated for referring the consumer to that advertiser’s website.

Cross-Device Reporting: We may also collect pseudonymous information across multiple browsers or devices to help us more accurately credit a publisher for their referral or marketing effort. Our cross-device reporting allows us to follow a your journey from a publisher to a potential transaction even if you decide to switch browsers or devices throughout that journey. For example, if you interact with a blog post on your phone referring them to purchase a certain pair of shoes, but later decide to switch to a desktop computer to make the purchase, we would be able to leverage our cross-device reporting technologies to ensure that the blog site is credited for the referral.

Insights and Analytics: Myyaffiliate also uses the pseudonymous information collected to provide our publishers and advertisers with reports to help with their marketing efforts. This information is generally used by our Clients to enhance their ad campaigns, such as by learning where the optimal ad placement is on their website, or learning what type of products or services consumers are more interested in. We will generally aggregate or de-identify any pseudonymous information prior to compiling these reports so that it is no longer technically feasible for the data to be linked to you, your device, or your household (“aggregated information”). For example, to measure the effectiveness of an ad or ad campaign, we may compile a report indicating how many unique individuals clicked on an ad. The report, in this example, would only consist of the ad itself and the total number of unique clicks, with no means for the recipient of the report to relate the clicks back to any particular individual. While many of these reports are at the aggregate level, we also produce reports that contain customer-level pseudonymous information. These reports can help our Clients identify areas of growth, such as identifying new partnerships or customer audiences.

Internal Business Purposes: Myyaffiliate may also collect and process personal information for some of our internal business purposes, such as:

· Auditing transactions, such as, counting ad impressions, verifying positioning and quality of ad impressions.

· Auditing our systems and services for compliance with applicable regulations and standards.

· Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.

· Debugging to identify and repair errors that impair existing intended functionality.

· Short-term, transient use, including, but not limited to, the contextual customization of ads shown as part of a single interaction.

· Performing services on behalf of our advertisers or publishers, such as maintaining or servicing accounts, providing customer service.

· Undertaking internal research for technological development and demonstration.

· Undertaking activities to verify or maintain the quality or safety of our systems and services, and to improve, upgrade, or enhance our systems and services.

· Other purposes as required or permitted by applicable law, or with your consent.

III. Information Sharing/Disclosure by Myyaffiliate

We only share or disclose your information for our limited business purposes on behalf of our Client, as described in this Privacy Notice, including:

Sharing with Myyaffiliate’s Partners and Affiliates: We may share your personal information with companies affiliated with Myyaffiliate for the purposes described in this Privacy Notice.

Disclosing to Clients (i.e., affiliate publishers or advertisers): We may disclose your personal information with our Clients for the purposes described in this Privacy Notice, including for attribution, cross-device reporting, and insight and analytics purposes.

Sharing with Service Providers: We may share your personal information with service providers to assist or facilitate in the services we provide to our Clients, such as vendors, administrative service providers, technology providers, and carefully selected partners for services including, but not limited to, data validation, enhancement, information verification and suppression services.

Sharing for Legal Purposes: In addition, we may share personal information with third parties in order to: (a) comply with legal process or a regulatory investigation (e.g. a subpoena or court order); (b) enforce our Terms of Service, this Privacy Notice, or other contracts with you, including investigation of potential violations thereof; and/or (c) respond to claims that any content violates the rights of third parties.  

Sharing for Fraud Prevention & Safety: We may share your personal information with third parties or service providers to protect the rights, property or personal safety of us, our platform, our customers, our agents and affiliates, its users and/or the public. We likewise may provide information to other companies and organizations (including law enforcement) for fraud protection, and spam/malware prevention, and similar purposes.  

Sharing in the Event of a Corporate Transaction: We may also share personal information in the event of a major corporate transaction, including for example a merger, investment, acquisition, reorganization, consolidation, bankruptcy, liquidation, or sale of some or all of our assets, or for purposes of due diligence connected with any such transaction.

IV. Protecting Personal Information

In addition to our Privacy by Design philosophy, Myyaffiliate takes extra steps to ensure that any personal information collected and retained is secured and protected from unauthorized access.

1. Security and Data Integrity

Myyaffiliate takes steps to help ensure that the data we possess is housed and transmitted securely. This may include various types of physical and electronic security, including firewall protections, encryption, hashing or truncation of data, and access controls to personal information. While neither we nor any platform can guarantee 100 percent safety from hacks or illegal intrusion, we employ efforts that are designed to ensure that this does not occur.

2. Retention

Myyaffiliate retains pseudonymized information collected online for 6 years, at which point such information is disassociated from the applicable consumer. Aggregated/De-Identified reports generated from such data may be retained for a longer period as ad delivery and reporting data.

V. Notice to California Residents

If you are a California resident, the California Consumer Privacy Act of 2018 (“CCPA”) requires certain additional information be provided regarding your rights with respect to your personal information. Please do not rely on the below information and disclosures in this section or otherwise directed to California residents if you are not a resident of California.

1. Your California Rights and Choices

California law allows you to make certain requests about your personal information, including pseudonymous information. Specifically, under the CCPA you have the right to request access to certain personal information we hold about you, and to opt out of the “sale” of your personal information. However, Myyaffiliate does not “sell” your personal information as defined by the CCPA.

We will not sell the personal information we collect about minors under the age of 16 unless we have the express authorization of the minor's parent or guardian as required by law.

You have the right to request the deletion of any of your personal information that we have collected from you and retained. But this is a limited right as we may be able to retain certain personal information subject to an exception under the CCPA or other applicable law.

VII International Data Transfers.

The Myyaffiliate Advertising Services and the Myyaffiliate Website are provided, supported and hosted in the Hong Kong Special Administrative Region of China. If you are using Myyaffiliate advertisers' services from outside Hong Kong, please note that your information may be transferred to, stored and processed at Myyaffiliate's facilities.

We will sign standard contractual terms with data exporters approved by the European Commission or take other similar measures to protect your personal information from infringement. We may share your personal information with third parties located in countries that may have data protection laws that are different to the laws of your country.

However, we have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Notice. These include implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect personal information they process from the EEA in accordance with European Union data protection law. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third party service providers and partners and further details can be provided upon request.

X. Definitions

“Cookies” are small text files that are downloaded and stored onto your device (e.g. a computer or smartphone).
